Cancellation Policy for the Delivery of GOODS

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last item of goods. To exercise your right of cancellation, you must inform us (Almliebe GmbH, Tettenweiser Str. 2, 94060 Pocking, telephone: 0853191630, fax: 085318882, email: kundenservice@almliebe.com) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the attached model cancellation form for this purpose, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of the right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs arising from the fact that you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your cancellation of this contract. For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier date. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired. We shall bear the cost of returning the goods. You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Early Expiry of the Right of Cancellation

The right of cancellation does not apply to contracts

  • for the supply of goods that are not pre-made and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;
  • for the supply of goods which may deteriorate quickly or whose expiry date would be quickly exceeded;
  • for the supply of alcoholic beverages, the price of which was agreed at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;
  • for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of cancellation expires prematurely for contracts

  • for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery;
  • for the supply of goods which, after delivery, have been inseparably mixed with other goods due to their nature;
  • for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
