General Terms and Conditions
1. General
The company Almliebe GmbH, Managing Directors: Stefanie Ragaller, Sonja Ragaller, Tettenweiserstraße 2, 94060 Pocking (hereinafter "Almliebe", "we" or "almliebe.com"), operates an online shop at the internet address www.almliebe.com, through which fashion articles, accessories, shoes and home accessories are offered for sale.
The following terms and conditions apply to all orders placed in the online shop almliebe.com and form part of the purchase contracts. By accepting the goods or services at the latest, these terms and conditions shall be deemed accepted. The terms and conditions valid at the time of the order shall apply in each case. The contract language is German.
2. Delivery and Shipping
Unless otherwise agreed, delivery shall be made to the delivery address you have provided. We assume that a delivery address differing from the billing address does not change our contractual partner. We shall therefore fulfil our obligations, particularly with regard to existing information requirements, in relation to the billing address provided.
We currently deliver to all countries listed under the "Shipping" menu item. If we deliver your order in several parts for technical reasons, we shall of course only charge the shipping costs once.
Should products you have ordered no longer be available, we reserve the right to withdraw from the offer or delivery contract, and we shall inform you immediately and refund any advance payments.
Deliveries to non-EU countries
Please note that we bear the costs for door-to-door transport, insurance of the goods, any costs for accompanying documents and customs clearance. We also cover the applicable import VAT and any customs duties. Please note that any foreign bank charges are to be borne by you.
All deliveries are made by the logistics service provider DHL. The terms and conditions of DHL apply additionally and can be viewed at www.dhl.com.
Shipping costs
The exact breakdown of shipping costs to the various countries can be found under the "Shipping" menu item.
We bear the costs for the return shipping of your returns within Germany and Austria. A DHL return label is enclosed with every order. No costs are covered for returns from all other countries.
3. Conclusion of Contract

The contract is concluded in the German language. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. By clicking the "Buy" / "Place order with obligation to pay" button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order is sent together with acceptance of the order immediately after submission by automated email. The purchase contract is concluded with this email confirmation.
All dimensions, drawings and illustrations are non-binding and may in part differ from the goods shipped. Improvements or changes to the goods are permissible insofar as they are reasonable for the buyer taking into account the interests of almliebe.com and are equivalent to the previously agreed service.
Only orders from customers who have reached the age of 18 can be accepted.
4. Orders
In the online shop almliebe.com, you can order in standard commercial quantities and while stocks last. Please refer to our website for individual product descriptions.
5. Ordering Options
Online via the online shop at www.almliebe.com (24 hours a day, 7 days a week)
To do so, you can click on the desired goods on the website and place them in a virtual shopping cart. At the end of your purchase, you will receive a summary of the goods at the total price (incl. VAT) as well as details of the shipping costs. Before submitting the order, you can check it for accuracy, particularly with regard to the billing and delivery address, price and quantity, and correct any input errors if necessary.
Receipt of your order will be confirmed to you without delay by electronic means. With this confirmation, you will also receive our bank details. Order receipt is monitored by almliebe.com.
6. Transport Damage / Obvious Defects
The goods are to be inspected by you or the person authorised by you to receive them upon receipt for transport damage and other defects. Obvious defects must be reported to us no later than two weeks after receipt of the goods. If the packaging is severely damaged, this must be noted by the delivery driver on the delivery note. Please refuse acceptance and inform us immediately.
7. Payment
Payment for the goods can be made by PayPal, by credit card (via PayPal), by direct debit (via PayPal) or by invoice (via PayPal). almliebe.com reserves the right to exclude certain payment methods in individual cases.
By bank transfer (prepayment)
For payment by bank transfer, please transfer the amount within 3 days of ordering, quoting the order number, to the recipient below. Dispatch will only take place after the invoice amount has been credited to our account. For all bank transfers, the customer bears the applicable transfer fees.

By PayPal
PayPal is a leading online payment service with which you can pay securely, simply, quickly and free of charge in our online shop. Use your existing PayPal account to conveniently pay for your order with us.
By credit card (via PayPal)
Credit card payment is processed through our service provider PayPal. Transactions are SSL encrypted according to the latest standards. Your credit card account will be charged upon completion of the order. For credit card payments, financial transactions are processed through the company Almliebe GmbH, Managing Directors: Stefanie Ragaller, Sonja Ragaller, Tettenweiser Str. 2, D-94060 Pocking. All prices are in euros.
By invoice (via PayPal)
You can also buy on account at almliebe.com. Processing is handled by PayPal. You only need to pay for the items you keep – with a payment period of 30 days. Please transfer each order separately and only quote the respective reference number as the payment reference. Transfer the invoice amount within 30 days, quoting your reference number, to the following account:

For "purchase on account", the invoice amount is due for payment to our external partner PayPal on the calendar day stated in the invoice (no later than 30 days after the invoice date). The "purchase on account" payment method is not available for all offers and requires, among other things, a successful credit check by PayPal. If the customer is permitted to purchase on account for certain offers after a credit check, the payment is processed in cooperation with PayPal, to whom we assign our payment claim. In this case, the customer can only make payment with discharging effect to PayPal.
By direct debit (via PayPal)
At almliebe.com you can also pay by direct debit. The amount will be debited from your account within 7 days.
Direct debit payment is processed through our service provider PayPal.
8. Retention of Title
The goods remain our property until full payment has been received.
9. Information on the Right of Cancellation
*** Cancellation Policy for the Delivery of GOODS ***
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
Right of Cancellation
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last item of goods. To exercise your right of cancellation, you must inform us (Almliebe GmbH, Tettenweiser Str. 2, 94060 Pocking, telephone: 0853191630, fax: 085318882, email: kundenservice@almliebe.com) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You may use the attached model cancellation form for this purpose, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of the right of cancellation before the cancellation period has expired.
Consequences of Cancellation
If you cancel this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs arising from the fact that you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your cancellation of this contract. For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier date. You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired. We shall bear the cost of returning the goods. You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or Early Expiry of the Right of Cancellation
The right of cancellation does not apply to contracts
- for the supply of goods that are not pre-made and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;
- for the supply of goods which may deteriorate quickly or whose expiry date would be quickly exceeded;
- for the supply of alcoholic beverages, the price of which was agreed at the time of conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
The right of cancellation expires prematurely for contracts
- for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery;
- for the supply of goods which, after delivery, have been inseparably mixed with other goods due to their nature;
- for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.

11. Cost Bearing Agreement
If you exercise your right of cancellation, you shall bear the regular costs of return shipping if the goods delivered correspond to the goods ordered and if the price of the item to be returned does not exceed €40, or if, in the case of a higher-priced item, you have not yet made the counter-payment or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you.
12. Value Added Tax
All prices include the currently applicable statutory value added tax.
13. Place of Performance and Jurisdiction
For customers who conclude the contract for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (consumers), this choice of law shall only apply insofar as the customer is not thereby deprived of mandatory provisions of the law of the state in which they have their habitual residence.
The place of performance for all services arising from the business relationship with the trader is, if the customer is a merchant, a legal entity under public law or a special fund under public law, 94060 Pocking. For all disputes arising from the contractual relationship, if the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Passau District Court, HRB 8799.
14. OS Platform
The European Commission has set up an internet platform for the online resolution of disputes ("OS platform") between businesses and consumers. The OS platform can be accessed at http://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
